The FTC has initiated an investigation into DaVita and Fresenius Medical Care, two prominent health care providers, for potential anti-competitive practices in the US dialysis market. According to a Politico report, which cites three anonymous sources, the inquiry commenced earlier this year and remains in its nascent stages.
The investigation predominantly focuses on allegations that these leading companies are obstructing physicians employed at their clinics from starting independent ventures or defecting to competitors. A central element under scrutiny involves the non-compete agreements imposed on nephrologists—specialists in kidney disease treatment. These agreements are believed to restrict physicians' mobility, potentially stymieing competitors' efforts to enhance home dialysis services, which could improve patient outcomes and industry competition.
As of this report, neither the FTC, DaVita, nor Fresenius Medical Care has issued comments regarding the investigation.
